What is Gross Negligence? It is a conscious and voluntary disregard of the need to use reasonable care, which is likely to cause foreseeable injury or harm.

Doctors, nurses and other health care professionals risk deadly exposure to COVID-19 every day as they work the frontlines to treat infected patients. A protection from medical malpractice lawsuits was issued in New York by the governor and this protection applies to hospitals, nursing homes and other healthcare facilities and to its physicians and other healthcare workers, making them immune from civil liability for any injury or death allegedly sustained directly as the result of an act or omission by the health care professional while providing medical services in the state’s response to COVID-19.

However, this protection does NOT extend to gross negligence. The exceptions to this protection from immunity to medical malpractice lawsuits are if the injury or death was caused by a health care professional’s gross negligence.
